Netbooks Video Learning provides a personalised subscription service that allows our subscribers to access Videos, Audio, Images & Documents (“Netbooks Video Learning content”) streamed over the Internet to certain Internet-connected TVs, computers, smartphones, tablets and other devices ("devices").

These Terms of Service govern your use of our service. As used in these Terms of Service, "Netbooks Video Learning service", "our service" or "the service" means the personalised service provided by Netbooks Video Learning for discovering and watching Netbooks Video Learning content, including all features and functionalities, recommendations and reviews, the website, and user interfaces, as well as all content and software associated with our service.

1. Acceptance of Terms.
1.1. 2. Eligibility
We may, in our sole discretion, refuse to offer the Services to any person or entity and change its eligibility criteria at any time. You are solely responsible for ensuring that these Terms of Service are in compliance with all laws, rules and regulations applicable to you and the right to access the Services is revoked where these Terms of Service or use of the Services is prohibited or to the extent offering, sale or provision of the Services conflicts with any applicable law, rule or regulation. Further, the Services are offered only for your use, and not for the use or benefit of any third party. If you are registering with Netbooks Video Learning on behalf of an entity or a third party, you represent and warrant that you have full authority to bind that entity to these Terms of Service.

3. Subscription & Services
3.1. In order to use the Services, you must register for an account on the Services (an “Account”). You must provide accurate and complete information and keep your Account information updated. You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use, as a username, a name that is otherwise offensive, vulgar or obscene. You are solely responsible for the activity that occurs on your Account, and for keeping your Account password secure. You may never use another person’s user account or registration information for the Services without permission. You must notify us immediately of any change in your eligibility to use the Services (including any changes to or revocation of any licenses from state authorities), breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. You shall have the ability to delete your Account, either directly or through a request made to one of our employees or affiliates.
3.2. Your membership/subscription to Netbooks Video Learning will allow access to services which you have purchased. Only the services which you have purchased will be available. You may sign up to more than one service.
3.3. The duration of your granted access to service is on a monthly basis - following successful payment. It is your responsibility to ensure your payment information is up to date and payments are made.

4. Processing of Personal Data
Your personal data will be treated in accordance with Netbooks Video Learning’s Privacy Policy, available at https://www.netbooks.live/privacy-policy.

5. Billing & Cancellation
5.1. Payments are accepted through the integrated Stripe API. Stripe is a trusted payment gateway.
5.2. Cancelation of your service will only take effect at the end of the calendar month you have paid for. Subscriptions will continue until they are cancelled by the user.
5.3. Unsuccessful payments will result in termination of your subscription.
5.4 Cancelations within 24 hours of purchase are eligible for refunds.

6. Netbooks Video Learning Service
6.1. The Netbooks Video Learning service and any content viewed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household. During your Netbooks Video Learning membership, we grant you a limited, non-exclusive, non-transferable right to access the Netbooks Video Learning service and view Netbooks Video Learning content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.
6.2. The Netbooks Video Learning service, including the content library, is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of Netbooks Video Learning content.
6.3. You agree to use the Netbooks Video Learning service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorised in these Terms of Service) content and information contained on or obtained from or through the Netbooks Video Learning service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Netbooks Video Learning service; use any robot, spider, scraper or other automated means to access the Netbooks Video Learning service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Netbooks Video Learning service; insert any code or product or manipulate the content of the Netbooks Video Learning service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Netbooks Video Learning service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Service or are engaged in illegal or fraudulent use of the service.
6.4. The quality of the display of the Netbooks Video Learning content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. All content is available in a range from 224p up to 720p (HD). The minimum connection speed for SD quality is 0.5 Mbps; however, we recommend a faster connection for improved video quality. A download speed of at least 5.0 Mbps per stream is recommended to receive HD content (defined as a resolution of 720p or higher). You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. The time it takes to begin watching Netbooks Video Learning content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your device.
6.5. Netbooks Video Learning content may contain content specifically provided by us or our partners and such content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any content accessed through your Netbooks Video Learning subscription.
6.6. We do not guarantee that any Netbooks Video Learning content will be made available on the website or through the Services. We reserve the right to, but do not have any obligation to, (i) remove, edit or modify any Netbooks Video Learning content in our sole discretion, at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Netbooks Video Learning content or if we are concerned that you may have violated these Terms of Service, or for no reason at all and (ii) to remove or block any Netbooks Video Learning content from the service.

7. Passwords & Account Access
The member who created the Netbooks Video Learning account and whose Payment Method is charged (the "Account Owner") has access and control over the Netbooks Video Learning account and the devices that are used to access our service and is responsible for any activity that occurs through the Netbooks Video Learning account. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, Netbooks Video Learning or our partners from identity theft or other fraudulent activity.

8. Warranties & Limitations on Liability
The Netbooks Video Learning service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the laws of your country of residence.

9. Class Action Waiver
WHERE PERMITTED UNDER THE APPLICABLE LAW, YOU AND NETBOOKS VIDEO LEARNING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, where permitted under the applicable law, unless both you and Netbooks Video Learning agree otherwise, the court may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.

10. Miscellaneous
10.1. These Terms of Service shall be governed by and construed in accordance with the laws of South Africa.
10.2. Netbooks Video Learning does not accept unsolicited materials or ideas for Netbooks Video Learning content and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Netbooks Video Learning.
10.3. To find more information about our service and its features or if you need assistance with your account, please visit the Netbooks Video Learning Help Page on our website. In the event of any conflict between these Terms of Service and information provided by Customer Support or other portions of our website, these Terms of Service will control.

10.4. If any provision or provisions of these Terms of Service shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
10.5. Netbooks Video Learning may, from time to time, change these Terms of Service. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.
10.6. We will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
